- Introduction
Welcome to NCK Farms, a multi-vendor marketplace where vendors can sell their products or services to customers. By accessing and using NCK Farms, you agree to be bound by the following terms and conditions. - Definitions
“Marketplace” means NCK Farms, the online platform where vendors can sell their products or services.
“Producer” or “Vendor” means a seller who has registered to sell their products or services on the Marketplace.
“Customer” means a user who has registered to purchase products or services on the Marketplace. - Registration
To become a Vendor on the Marketplace, you must register and create an account. You agree to provide accurate and complete information during the registration process. You are responsible for maintaining the security of your account and password, and for all activities that occur under your account. - Product Listings
As a Vendor, you may list your products or services for sale on the Marketplace. You are responsible for ensuring that your product listings are accurate and comply with all applicable laws and regulations. You may not list products or services that are illegal, infringe on intellectual property rights, or violate any other third-party rights. - Sales and Payments
When a Customer purchases a product or service from you on the Marketplace, you agree to fulfill the order in a timely manner and to provide accurate and complete information about the product or service. NCK Farms will process the payment and deduct a commission fee before sending the payment to you. You agree to pay any applicable taxes or fees associated with your sales on the Marketplace. - Shipping and Delivery
As a Vendor, you are responsible for shipping and delivering your products or services to the Customer in a timely manner. You must provide accurate and complete information about shipping costs and delivery times in your product listings. You must also comply with all applicable shipping and delivery laws and regulations. - Returns and Refunds
As a Vendor, you are responsible for handling returns and refunds for your products or services. You must provide accurate and complete information about your return and refund policies in your product listings. You must also comply with all applicable laws and regulations regarding returns and refunds. - Intellectual Property
You agree that NCK Famrs owns all rights, title, and interest in and to the Marketplace, including all intellectual property rights. You may not use NCK Farms’s trademarks or copyrighted materials without NCK Farms’s prior written consent. - Termination
NCK Farms may terminate your account and access to the Marketplace at any time and for any reason, including if you violate these terms and conditions. You may also terminate your account at any time by contacting NCK Farms. Upon termination, you will no longer be able to sell products or services on the Marketplace. - Disclaimer of Warranties
The Marketplace is provided “as is” and without warranty of any kind. NCK Farms does not guarantee the accuracy, completeness, or timeliness of the Marketplace or any information on the Marketplace. - Limitation of Liability
NCK Farms will not be liable to you for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Marketplace. NCK Farms’s total liability to you for any claims arising from or related to your use of the Marketplace will not exceed the total amount of fees paid to NCK Farms by you in the 12 months preceding the claim. - Governing Law and Jurisdiction
These terms and conditions will be governed by and construed in accordance with the laws of Republic County, Kansas, without giving effect to any principles of conflicts of law. Any dispute arising fromor relating to these terms and conditions will be resolved in the courts of Republic County, Kansas. - Changes to Terms and Conditions
NCK Farms may update these terms and conditions at any time and without notice. You are responsible for reviewing these terms and conditions periodically. Your continued use of the Marketplace after any changes to these terms and conditions constitutes your acceptance of the updated terms and conditions. - Miscellaneous
These terms and conditions constitute the entire agreement between you and NCK Farms regarding your use of the Marketplace. If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. NCK Farms’s failure to enforce any right or provision of these terms and conditions will not be deemed a waiver of such right or provision.
By accessing and using the Marketplace, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, you may not use the Marketplace.
